Coast and Cedar operates this online store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated footwear shopping experience (the “Services”). Coast and Cedar is powered by Shopify, which enables us to provide the Services to you.

These Terms and Conditions (“Terms”), together with any policies referenced herein, describe your rights and responsibilities when you use the Services. These Terms constitute a legally binding agreement between you and Coast and Cedar under the laws of India, including the Information Technology Act, 2000, the Consumer Protection Act, 2019, and all applicable rules and regulations thereunder.

All products sold by Coast and Cedar are genuine and comply with applicable Indian quality and safety standards. Products are sold for personal use only and are not intended for commercial resale or export.

When you place an order on our store, you are making an offer to purchase. Coast and Cedar reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Coast and Cedar confirms acceptance via email. We must receive and verify your payment before your order is accepted.

Please review your order carefully before submitting. Once an order is accepted, we may be unable to accommodate cancellation requests. In the event that we do not accept, modify, or cancel an order, we will attempt to notify you via the email, billing address, or phone number provided at the time of the order.

Your purchases are subject to return or exchange solely in accordance with our Refund and Return Policy [LINK], which complies with the Consumer Protection Act, 2019.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 4 – PRICES AND BILLING

All prices listed on our store are in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST) unless expressly stated otherwise. Prices, discounts, and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time of order placement, as confirmed in your order confirmation email.

Shipping and handling charges, if any, will be displayed separately at checkout prior to payment.

You agree to provide current, complete, and accurate purchase and payment information for all purchases. You agree to promptly update your account information as needed to ensure we can complete your transactions.

You represent and warrant that: (i) the payment information you provide is true, correct, and complete; (ii) you are duly authorized to use the payment method for the purchase; (iii) charges incurred by you will be honored by your payment provider; and (iv) you will pay all charges at the posted prices, including applicable taxes and fees.

In compliance with the Consumer Protection (E-Commerce) Rules, 2020, we will display all mandatory charges prior to the completion of your purchase.

SECTION 5 – SHIPPING AND DELIVERY

We ship only to addresses within India. All delivery timelines are estimates and are not guaranteed. We are not liable for delays caused by shipping carriers, natural disasters, public health emergencies, strikes, or other events outside our reasonable control.

Once we transfer your order to the carrier, risk of loss and title pass to you. Please inspect your order upon receipt and contact us immediately at coastandcedar@gmail.com if your order arrives damaged or incomplete.

In compliance with applicable Indian consumer protection laws, if a delivery fails due to our error or the carrier’s fault, we will arrange a re-delivery or issue a full refund as appropriate.

SECTION 6 – CONSUMER RIGHTS (CONSUMER PROTECTION ACT, 2019)

As a consumer purchasing goods in India, you are entitled to certain rights under the Consumer Protection Act, 2019 (“CPA”) and the Consumer Protection (E-Commerce) Rules, 2020. Nothing in these Terms limits or excludes any rights you have under applicable Indian consumer protection laws, including:

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material from the Services without our prior written consent.

Coast and Cedar’s names, logos, and product names are trademarks of Coast and Cedar or its affiliates. You must not use such trademarks without our prior written permission. All rights not expressly granted herein are reserved.

You may be provided access to customer tools offered by third parties as part of the Services. We neither monitor nor control such tools. We provide access to such tools “as is” and “as available” without any warranties or representations. We shall have no liability arising from your use of optional third-party tools.

Use of optional tools is entirely at your own risk and discretion. You should ensure that you are familiar with and agree to the terms on which such tools are provided by the relevant third-party providers.

Coast and Cedar is powered by Shopify, which enables us to provide the Services to you. However, all sales and purchases made in our store are made directly with Coast and Cedar. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any transaction between you and Coast and Cedar, including any injury, damage, or loss resulting from purchased products or services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Coast and Cedar.

We may terminate this agreement or your access to the Services at any time, at our sole discretion, without notice. You will remain liable for all amounts due up to and including the date of termination. Sections relating to Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and any other provisions that by their nature should survive termination, shall continue to apply.

EXCEPT AS EXPRESSLY STATED BY COAST AND CEDAR AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE INDIAN LAW, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY REPRESENTATION, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Nothing in this clause limits or excludes any rights you have under the Consumer Protection Act, 2019 or other applicable Indian consumer protection laws that cannot be contractually excluded.

SECTION 18 – LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE INDIAN LAW, IN NO CASE SHALL COAST AND CEDAR, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THE SERVICES.

Notwithstanding the above, our total liability to you for any claim arising out of or relating to these Terms or your use of the Services shall not exceed the amount paid by you for the specific product or service giving rise to the claim.

Nothing in this clause limits or excludes liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under applicable Indian law, including the Consumer Protection Act, 2019.

SECTION 19 – INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Coast and Cedar, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, and service providers from any losses, damages, liabilities, or claims, including reasonable legal fees, arising out of: (1) your breach of these Terms; (2) your violation of any applicable law or the rights of any third party; or (3) your access to and use of the Services.

We will notify you of any indemnifiable claim. We may, at our election, control the defense and settlement of such claim. You will cooperate in the defense of any such claim.

Complaints should be submitted in writing. We will acknowledge your complaint within 48 hours and endeavour to resolve it within 30 days of receipt.

If any provision of these Terms is determined to be unlawful, void, or unenforceable under applicable Indian law, such provision shall be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed from these Terms without affecting the validity or enforceability of the remaining provisions.

SECTION 22 – WAIVER; ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. These Terms, together with any policies or operating rules posted by us on the Services, constitute the entire agreement between you and us with respect to the subject matter hereof, and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.

You may not delegate, transfer, or assign these Terms or any of your rights or obligations under them without our prior written consent. Any such attempt will be null and void. We may transfer or assign these Terms and our rights and obligations without your consent or notice.

Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms.
